Confirm the dates before drawing conclusions

An overstay concern can arise from confusing the visa’s expiry date, authorised duration and the rolling short-stay limit. Gather the visa, passport stamps, tickets and any reliable entry or exit records.

Leaving briefly does not reset the clock

A weekend outside Schengen is not a new allocation of 90 days. The rolling calculation looks back at the relevant period. Do not book a short “visa run” on the assumption that all previous stays disappear.

If records conflict, seek clarification rather than selecting the dates that produce the most favourable result.

If illness or an emergency prevents departure

Keep evidence of the event and contact the competent immigration authority in the country where you are. The Visa Code provides for extensions in specified circumstances; this is not an automatic extra holiday.

The Netherlands’ IND guidance describes extension requests involving serious circumstances. That procedure is a Netherlands example, not an instruction to contact IND when you are in another country.

Preserve medical evidence, cancellation notices and communications. Check whether insurance needs extending, but do not confuse insurance cover with permission to remain.

Do not rely on a universal fine or ban

The outcome depends on the circumstances and applicable procedure. This guide does not promise that a short overstay is harmless or that a particular fine settles every consequence.

If permission has already expired, seek prompt qualified advice and official instructions. Do not alter records, invent an emergency or assume an onward booking resolves the issue.

For a later application

Maintain an accurate chronology and records explaining what happened. Answer questions truthfully and have your reviewer consider the actual documents. An explanation should be factual and supported, not a claim that future approval is assured.
